Student Visa (LLM SQE) + Skilled Worker Visa (TC)

Hi, I am international and due to start my TC in Sept 2025. I was on a Graduate Visa from 2021- early 2023 before I switched to my current Skilled Worker Visa. I planned to do the LLM SQE full time from Sept 2024 - Sept 2025 with Uni of Law under a Student Visa before I start the TC in Sept 2025 under a Skilled Worker Visa. There is an overlap of about a month between the end of course date and start of employment (“overlap”).

Earlier this year, I was told by ULaw that the whilst the end date appears to conflict with my start date with the firm, my start date in the office does not overlap with the course - Teaching concludes in July 2025 and I will have coursework assessments to complete in late July/early Aug 2025. Following the submission of this coursework I will be required to attend a 30 min online viva (oral presentation) in Sept 2025 to be questioned on the content of one of my coursework submissions. It appears that this takes a short time and I will be given notice in advance so I can notify the team I’ll be working with in the office.

Having being told this, I made plans to start the course as planned in Sept 2024 and to continue with my current employment until then so I can have more time to save up to help support myself during the year of study. This is important to me because while I appreciate the firm’s support in providing a maintenance grant and a small loan, I am concerned about the increased cost of living and increase in visa and immigration fees (The firm is is not helping with the Student Visa costs). Based on my calculated projections, which factors in planned reductions in expenses such as rent and other living costs, I have come to the realisation that managing finances may present certain challenges.

Last week, the firm got in touch with me saying there might be a problem if I were to start the LLM SQE in Sept 2024 due to the overlap. They told me that I should start the LLM SQE earlier in March 2024. That was when I was made aware of the recent immigration rule changes that the employment start date for the Skilled Worker Visa Certificate of Sposorship (CoS) cannot be earlier than the end date of my course. I did some research and came across rule ST26.6 which says seemingly says that I can start the TC in Sept 2025 under my Student Visa anyway. I feel disheartened because I had already worked out a financial plan that would enable me to support myself (in addition to the firm's maintenance grant) during my studies according to old timelines. I also made a lot of important personal plans which would be impacted if I have to start the SQE earlier than planned.


Has anyone got any advice as to what I can do to start my studies as planned in Sept 2024? I intend to do the SQE full time so that I can concentrate on my studies.

1. After graduate visa, did you take up a paralegal job and the company sponsored your skilled worker's visa ? Was getting this visa sponsorship easy?
2. Were you working as a paralegal/other job during 2 year graduate visa?
2. Is the TC firm different from your current firm and thats why you need a new work visa?

1. No, I didn't undertake a paralegal job. The skilled worker visa is for a graduate scheme. I had applied to different firms (law and non law), received lots of rejections but this was one of the few successful ones - not the easiest but not impossible!
2. I was not working during my graduate visa - I took the time while on this visa to apply for jobs.
3. Yes, that's correct

1. I'm taking the SQE law essential conversion online course at ulaw right now. I have a question: If I have to have two years legal experience may I have it from my own country? I.e, India. Or is it two years of legal job experience in the UK which is required?

2. Which LLM specialisation course—corporate law, commercial law, international and business law, or any other—has the greatest employment prospects in the United Kingdom?

3. Can I give the SQE exam without two years of UK experience?

4. I'm having a lot of trouble deciding which course is better for my career prospects—should I do an LLm SQE 1&2 prep course or LLm in a specialization? Please guide

1) yes, if you are qualified

2) no LLM will improve your general job prospects directly. You will only be advised to do an LLM if you have interest in the topic of the LLM or want to go into that specialist area.

3) yes - you just need a degree level qualification to sit the SQE assessments

4) the courses are not designed to improve your job prospects, they are designed to help you pass the SQE.

Hi,

I hope you can see this message. I am an international student in the same situation studying at ULaw. I was supposed to start in August this year but the ULaw LLM course runs until October. Earlier this week my firm notified me of the law changes and said that I need to defer by 6 months. I am similarly disheartened as it is extremely difficult for me to work out a way to support myself financially, given such short notice to defer.

I also raised ST26.6 to my firm, but they replied saying that they are concerned that ST 26.6(c) means that my student visa and its work conditions remain in place until the outcome of the SWV application. Therefore, as soon as a decision on the SWV has been made, which may well be before the course ending date, ST 26.6 ceases to take effect as I will immediately be switched to the SWV. They said that I will no longer be able to work as my rights will then be based on the SWV.

However, I found that the SWV allows you to start earlier than planned in the guidance for Skilled worker sponsor employers, paragraph S3.13:

S3.13. A worker can start working in their sponsored employment as soon as they have permission to enter or stay in the UK, even if this is before the start date recorded on their CoS. You do not have tell us if the worker’s start date has been brought forward after they have been granted permission.

I think that firms should be able to issue a Certificate of Sponsorship (CoS) with a start date of no earlier than the ULaw course ending date, which you then use to apply for a SWV. This application will allow the exception at ST26.6 to start a full-time job on the Student visa up to 3 months before the end of the course. By allowing full-time job, ST26.6 would mean that the normal 20-hour per week limitation does not apply. The student visa and its work conditions remain in place until the outcome of the SWV application. As soon as a decision has been made on the SWV, you can start sponsored employment, even if before the start date on the CoS according to S3.13.

The immigration rule changes that the employment start date for the CoS cannot be earlier than the end date of the course, but the date on the CoS is the sponsored employment start date, not your actual start date at the firm - in the overlapping period you are not doing sponsored employment as your rights are based on the Student visa under ST 26.6.

I hope this helps as I understand how frustrating this is. Best of luck and I hope this issue is resolved.
